欧盟商标及国际性商标注册中的转换程序流程：

Conversionispossibleinthefollowingcircumstances:

在下列情况下可以转换：

1.WhereanEUTMapplicationhasbeenfinallyrefusedbytheOffice,inadecisiononabsoluteorrelativegroundsforrefusalduringexaminationoroppositionproceedings;

欧盟商标在核查全过程或质疑程序流程因其肯定原因或相对性原因被官方网最后驳回申诉；

2.WhereanEUTMapplicationhasbeenwithdrawnbytheapplicant;

申请者撤销欧盟商标；

3.whereanEUTMapplicationisdeemedtobewithdrawn,namelywhenclassfeesarenotpaidwithintherelevanttimelimitafterfilingtheapplication;

欧盟商标在提交后，未按时交纳类型花费，而被视作撤销。

4.whereanEUTMregistrationceasestohaveeffect,whichappliesinthefollowingcircumstances:

欧盟商标在下列情况下无效的：

(1)whereanEUTMregistrationhasbeenvalidlysurrendered;

欧盟商标已被舍弃申请注册的情况；

(2)whereanEUTMregistrationhasnotbeenrenewed;

欧盟商标未商标续展的情况；

(3)whereanEUTMregistrationhasbeendeclaredinvalidbytheOfficeorbyaEuropeanUniontrademarkcourt;

欧盟商标局或欧盟商标法院公布欧盟商标申请注册失效的情况；

(4)wheretherightsoftheproprietorofanEUTMregistrationhavebeenrevokedbytheOfficeorbyanEUTMcourtexceptinthecaseofrevocationduetonon-use.

欧盟商标申请注册每个人的权益已被负责人局或欧盟商标法院撤消，但因未采用而撤消的情况以外。

Conversionmayberequestedforallorforsomeofthegoodsorservicestowhichtheactordecisionmentionedaboverelates.Andtherequestmaybeintonationaltrademarkapplicationsinone,moreoralloftheMemberStates.

转换要求可对于以上个人行为或决策所涉及到的所有或部份商品或服务项目。该要求可以在一个、好几个或全部会员国进到国家申请商标。
